SHC Adjourns Karachi Nazim Petition Till Aug 6
KARACHI: Sindh High Court on Friday adjourned the hearing of a petition till August 6 filed by City Nazim Karachi against alleged intrusion in his powers by the provincial government.
A division bench of the Sindh High Court comprising Justice Khilji Arif Hussain and Justice Syed Mehmood Alam Rizvi is hearing a constitution petition filed by Syed Mustafa Kamal and others against alleged interference in local bodies affairs by Sindh government.
On Thursday, Sindh Additional Advocate General (AAG) Sarwar Khan appeared for the respondents including the provincial government, chief secretary, local government secretary, special secretary to the Sindh chief minister and the Board of Revenue member.
The AAG filed a written reply before the court. The petition was termed ‘not maintainable’ in the para-wise reply, besides terming the petition as ill advised, claiming that the Sindh chief minister has absolute powers in such issues.
The AAG submitted that the government land of Sindh was granted/allotted under section 10(1) Colonisation of Government Land Act 1912. The statement of conduct for the grant of land for non-agricultural purposes under section 10(2) Colonisation of Government Land Act 1912 was notified in February 2006 that provided that the chief executive of province was the land allotting authority.
The bench today adjourned the hearing till August 6, says the channel.
